1. Acceptance of Terms
By accessing or using HyperDSK ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. HyperDSK provides inventory management, point-of-sale, leasing, customer management, and reporting tools for businesses.
2. Description of Service
HyperDSK is a cloud-based business operations platform. Subject to these terms, we grant you a non-exclusive, non-transferable right to access and use the Platform for your internal business operations. Features include catalog and inventory tracking, sales and POS processing, lease management, customer records, and analytics reporting.
3. Account Registration & Security
You must create an account to use the Platform. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You agree to notify us immediately of any unauthorized use. You must be at least 18 years old to register.
4. User Obligations
You agree not to: (a) use the Platform for any unlawful purpose; (b) interfere with or disrupt the integrity or performance of the Platform; (c) attempt to gain unauthorized access; (d) upload viruses, malware, or malicious code; (e) store or transmit infringing or tortious material.
5. Payment Terms
Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as expressly stated in our refund policy. We may change our fees with 30 days notice. Late payments may result in suspension of service.
6. Intellectual Property
The Platform, its original content, features, and functionality are owned by HyperDSK and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of any business data you enter. We claim no intellectual property rights over your data.
7. Data Privacy
Your use of the Platform is also governed by our Privacy Policy. We implement reasonable security measures to protect your data but cannot guarantee absolute security. You are responsible for backing up your own data regularly.
8. Limitation of Liability
To the maximum extent permitted by law, HyperDSK shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Platform. Our total liability shall not exceed the amount you have paid us in the twelve months preceding the claim.
9. Termination
We may terminate or suspend your account at any time for violation of these terms. Upon termination, your right to use the Platform ceases immediately. We will provide you with a reasonable period to export your data, after which it may be permanently deleted.
10. Changes to Terms
We reserve the right to modify these terms at any time. Material changes will be notified via email or through the Platform. Continued use after changes constitutes acceptance of the new terms.
